Beddit Limited Warranty

Your Beddit consists of a Bluetooth-enabled sensor, a USB power adapter, and a mobile app, which you must download separately. This Limited Warranty covers only the sensor and power adapter.

What is covered. Misfit Wearables Corporation warrants the sensor and power adapter against defects in materials and workmanship under normal use for one year from the date of original purchase by the end user.

What is not covered. Limited Warranty does not apply to normal wear and tear or damage caused by any of the following: misuse (including failure to follow product documentation), neglect, disassembly, washing in the washing machine or drying in the dryer, pets, water or liquid spills, alterations, unauthorized repairs, and external causes such as thermal or environmental conditions. It also does not cover loss of the adhesive from repeated applications of the sensor to bedding (see product instructions on how to replace the adhesive tape). Misfit wearables Corporation does not provide any warranty for the mobile app or device that runs the app. This Limited Warranty does not guarantee that the use of your Beddit with the mobile app will be uninterrupted or error free.

Exclusive Remedy. If a defect arises and you return the product during the one-year warranty period, we will in our sole discretion and to the extent permitted by law either replace the defective part with a new or refurbished one that is functionally at least equivalent to yours, or refund all or part of the amount you paid. If we replace the product, the replaced product will continue to be warranted for the remaining time of the original warranty period. All returned parts for which you have received a refund or replacement will become the property of Misfit Wearables Corporation.

THIS LIMITED WARRANTY IS THE ONLY EXPRESS WARRANTY MISFIT WEARABLES CORPORATION PROVIDES FOR BEDDIT, AND THE THE ABOVE REMEDY IS YOUR SOLE REMEDY, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MISFIT WEARABLES EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES AND REMEDIES OF ANY KIND, WHETHER EXPRESS, STATUTORY, OR IMPLIED, EXCEPT THAT ANY IMPLIED WARRANTIES OR MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED IN DURATION TO THE ONE-YEAR PERIOD OF THIS EXPRESS WARRANTY. Some States do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

LIMITATIONS AND EXCLUSIONS, YOU EXPRESSLY UNDERSTAND AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MISFIT WEARABLES CORPORATION SHALL NOT BE LIABLE TO YOU UNDER ANY THEORY OF LIABILITY-WHETHER CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE-FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES THAT MAY BE INCURRED BY YOU IN CONNECTION WITH MISFIT LABS AND BEDDIT OR THESE TERMS, INCLUDING AND LOSS DATA, WHETHER OR NOT MISFIT WEARABLES CORPORATION OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF ANY SUCH LOSSES ARISING, YOU EXPRESSLY UNDERSTAND AND AGREE THAT, TO MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MISFIT WEARABLES CORPORATIONS TOTAL LIABILITY IN CONNECTION WITH MISFIT LABS AND BEDDIT OR THIS LIMITED WARRANTY WILL NOT EXCEED THE PURCHASE PRICE THAT YOU ACTUALLY PAID FOR YOUR MISFIT LABS AND BEDDIT. Some States do not allow exclusion or limitation or incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Repairs. There are no repairs that you can safely do on the sensor or power adapter except replacing the adhesive tape of the sensor. The adhesive tape on the sensor will lose its stickiness over time as the sensor is attached to and removed from your bed. This is normal, and it is not covered by this Limited Warranty. See the product instructions for how to replace the adhesive tape. All other repairs are unauthorized and will void this Limited Warranty.

You expressly understand and agree that if you replace the adhesive tape, Misfit Wearables Corporation is not liable for any damages to the sensor, your bed, your bedding, or any property caused by the replacement adhesive tape.

How to obtain warranty service. You must present the following information to make a warranty claim: (i) model of your product; (ii) your full address and contact information; and (iii) your purchase receipt or other proof of the date purchased.

No employee or representative of Misfit Wearables Corporation or any third party is authorized to modify, extend, or add to this Limited Warranty. If any term of this Limited Warranty is held to be illegal or unenforceable, the remaining terms of this Limited Warranty will remain in full force and effect.

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
